Legal Drinking Age
It is an offence to buy or attempt to buy alcohol if you are under the age of 18. It is also an offence for any person over the age of 18 to purchase alcohol on behalf of somebody who is under the age of 18. Please note that Exel wines will not sell alcohol to any person who we believe to be under the age of 18. In the event that the purchaser appears under this legal age upon receipt of goods then the goods will be returned to us and you will receive a refund less any reasonable delivery and administrative costs.
How to order
You may order wines, spirits or other goods by the following methods listed below. You will have a right to cancel such orders as set out below, please see the paragraph headed "return of goods / cancellation" for details

Go to checkout and complete your details (existing customers simply
login in). The Check out proceedure will give you a full breakdown of taxes and shipping costs.
Proceed through the full order process and then confirm order.
Payment is taken online using a secure payment encryption via RBS World Pay (NB. We do not store or have access to your credit/debit card details).
In line with Data Protection legislation, we will only use your details for marketing purposes to provide you with information about products and
services should you choose to opt-in to this service. Once your order is complete cross checks to ensure the products are available and ready for dispatch. Once complete you will receive an acceptance of your order along with details of the estimatd dispatch of your wines.
Our contract with you
Your order is an offer to buy from us. There will be no contract of any kind between you and us unless and until we accept your order by way of written order acceptance along with details of the dispatch of your order. At any point up until then, we reserve the right to decline to supply goods or services to you for any reason.
Description & Prices
The description and prices payable for the items or services that you order are clearly set out in our online price list or by specific request by contacting us. If, by mistake, we have under or over-priced an item or service, we may cancel your order provided we refund you any payments you have made. Before a refund is made we will make all possible endeavours to find a suitable alternative for you. In the event that an item has been over charged a full refund of the difference will be given. This does not affect your statutory rights.
We reserve the right to change our prices without prior notice. Please refer to the latest price list or our website for all current prices. Please note prices issued in the latest price list or on our website supersede any prices set out elsewhere if they are different.
Prices listed for wines are quoted either per bottle or per case as described and include VAT at the current rate. A case size will be outlined at the time of ordering.
Prices are subject to currency and market fluctuations and changes in duty and VAT. If any other currency is stated, this is subject to currency fluctuations and is an indication only. Any necessary taxes, duties and delivery charges will be liable within the UK, although initial prices are displayed exclusive of delivery costs these will automatically be added to your order before payment.

Free Of Charge Delivery
As part of our commitment to great value for money, we are always increasing the amount of products that qualify for our free delivery promotion on orders over 12 bottles. At present this covers all wines but does not include spirits. Where this is a case of wine the individual bottles within the case will count. Not all of our products qualify for this promotion, at present Non-wine products and some wines that are being sold under a Brockerage deal do not qualify for this promotion. How to Pay
We accept Maestro, Visa, Mastercard, or cheques payable to `South Bistro Scotland ltd’. By specific request payment may be made by bank transfer if a suitable account has been set up. Orders may be delayed by credit card authorisations not being confirmed by the respective banks. It is the customer's responsibility to contact their bank to speed up this process if the order is required urgently. Credit cards are always debited in UK pounds sterling. Please note that payment will be taken in full at the time of ordering.
Online payments are made using a secure payment encryption via RBS World Pay.
Quality Guarantee
We are committed to providing our customers with an unsurpassed level of service and are equally committed to ensuring we provide a safe, legal, and first class product.
As many of our wines are vintage wines we cannot be held liable for the quality of any wines suspected to be corked. We make every effort to store our wines in a controlled environment and ensure that they come from only sources with the highest provenance. Vintage wines will not be liable for automatic refund but will be assessed on an individual basis.
Wines from our non-vintage and fine wines collections will be liable for a refund if the wines are found to be corked or damaged through no fault of the recipient. This will be assessed on a case-by-case basis taking into account the storage conditions of the wine. Complaints about faults with wines will usually only be accepted where the wine has been correctly stored (horizontally, at a temperature of 10-15 degrees in darkness). If you believe a wine to be faulty please contact us on +44 (0)1738 493535 or email us at orders@exelwines.co.uk you will be liable to safely and securely returning the goods by an insured and tracked service so we can have it tested and suitable arrangements be made for a refund to be given where appropriate. This does not affect your stutory rights
Receipt of Goods
Orders will be delivered on a next day basis from the date of dispatch, within the UK. We cannot be held responsible if there is a delay in the courier time that is outwith our control, but every effort will be made to ensure this does not happen.
Upon delivery you will be asked to sign for your wines, at this point you are liable to check your consignment to ensure it is not damaged and is delivered as ordered. Should you be unable to complete this check at the time of delivery please sign the delivery as “UNCHECKED” or refuse to accept the delivery. If signed as UNCHECKED a grace period of three days will be given to check the wine and ensure its condition. This does not affect your statutory rights.
We are unable to guarantee credit or replacements unless we are notified within these restrictions. Please be aware that in some circumstances multi-case orders can become separated and not be received in one delivery. If you do not receive all of your wines within 3 days from the expected delivery date please contact us. If you will not be at the delivery address at the time of delivery and wish us to leave your order in a safe place or with a neighbour, please advise us otherwise you may be liable for any redelivery costs.

Substitutes/Availability
All wines and spirits and other goods are subject to availability. We try to ensure that our wines displayed are correct in terms of availability, price and description. On some occasions, however, items may go out of stock quicker than they can be updated online we therefore reserve the right to select and deliver to you a substitute (of equal or higher value) to the wine you have ordered. This will usually only be done after we have gained your express permission to do so, this does not affect your statutory rights. If, after suitable attempts have been made by us, we are unable to supply a particular item, or supply a substitute, we will not be liable to you except to ensure that you are fully refunded for that item.
Ownership
All wines and spirits or other goods ordered remain the property of Exel Wines until payment is received in full and successful delivery has been made.
Export Orders
We deliver to a large number of countries worldwide using a network of experienced and specialist shippers and couriers. Export orders are welcome at any value providing you are happy to pay the individual carriage costs.
Overseas orders may be liable to certain taxes and legislation in the destination countries, which the recipient shall be liable for payment of and adherance to. Exel wines shall not be liable for the payment of any importation taxes or other costs associated unless previously agreed.
All overseas orders will be packaged in suitable export cartons to ensure safe and legal transit; this may involve removing wine from its original casing we may be able to arrange to ship original cases by prior arrangement.

Return of Goods/Cancellation
Orders for goods may be cancelled within seven working days of receipt of goods and that the request to cancel is received in writing. Any cancelled order will be required to be returned to ourselves by an insured tracked service and at your expense. If goods are returned in an unnaceptable or 'as sold' condition then a pursuit will be made to recover any financial loss to Exel Wines. This does not affect your statutory rights. Sale or Return
Sale or return is only available by prior arrangement and at the sole discretion of Exel Wines.
Privacy Policy
When you register for some of our services and offers we will collect relevant information about you to provide such services. You have a right of access to all information we hold about you. All contact information collected by Exel Wines will be used solely by The South Bistro (Scotland) Ltd Company, we will never sell your details on to a third party but we will use your details to keep you updated, in a timely fashion, with our latest products, services and partner offers. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998. On every email that we send there will also be an option to manage your account subscriptions and to unsubscribe from any future emails.
Verification Checks
To ensure that your credit, debit or charge card is not being used without your consent; we or our credit processing agents will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.
All information revealed through such checks shall be used by us in accordance with our Privacy policy although we may refer any information which appears to be fraudulent or unlawful to relevant third parties such as police or other enforcement authorities, banks, credit card companies as may be appropriate.
Applicable Law
From time to time Exel Wines may offer other services, special offers, discounts, promotions etc together with services not specifically referred to in these terms and conditions. Such matters shall be subject, in addition to these terms and conditions, to specific terms and conditions relating to such matters. By taking the service or special offers, discounts, promotions you agree to be bound by such additional terms and conditions.
Nothing in these terms and conditions limits or excludes your statutory rights as a consumer. Exel wines trades as a Scottish company, part of the South Bistro Scotland Company and as such all legal considerations are taken under Scottish Law where applicable.

Broking
On occasion, and at our sole discretion, we are prepared to offer you a wine brokerage service where we can find buyers for your wine. If we agree a sale of your wine to a third party we will purchase your wine from you, at a previously agreed price, and then sell it on to the third party. Our purchase from you will always be conditional upon the third party completing the purchase of the wine from Exel Wines.
In agreeing to Exel Wines broking terms, you are authorising Exel Wines to have a pre-determined exclusivity period to be able to offer the wine for general sale. This period will be pre-agreed on an individual basis. A price we will pay you for the wine on successful sale will always be pre-agreed. If we sell the wine to a third party within the exclusivity period, then our purchase from you will be deemed to have occurred immediately before our sale and, the sum agreed payable to you will usually be paid within 30 working days of the receipt by us of the proceeds of our sale to the third party. If Exel Wines have not found a buyer for your wines within the exclusivity period, Exel Wines will contact you to discuss a renewal of the period and/or a price adjustment or the return of the wine to you or storage of the wine.
The purchase and resale of your wines is conditional on their safe receipt (at your expense unless otherwise agreed) into the purchasers’ hands in the agreed condition, in the opinion of the purchaser. You will also be informed if the wines are to be made available for sale, online or via our retail shop. Typically, if you are offering wines for broking the wines will be in original wooden case (OWC) and in good condition or be from a reputable cellar with excellent provenance.
Where payment is withheld by the purchaser and goods are to be returned (either by the purchaser or at your request prior to the sale, or where the wines can not be sold), transportation will be at your expense, unless previously agreed using either Exel Wines standard delivery charges or organised at your expense and liability.
Full broking terms and conditions will be prepared as a prior arrangement to our displaying your wines for sale.
